A Public Adjuster is “someone who negotiates and/or settles, on behalf of the insured, a first-party claim for loss or damage covered by an insurance contract.” Public Adjusters represent you the insured; not the insurance company.
Our professional staff is state-licensed, state-regulated, bonded, and must complete 24 hours of continuing education, including ethic courses, every two years.
Are Contractors allowed to handle claims on behalf of their customers in MN?
NO. In a joint bulletin (2010-4) the Department of Labor and Industry, and the Department of Commerce made clear the intent of MN law regarding what contractors can and cannot do. Contractors can offer an estimate and an opinion on their estimate, but they can not negotiate, or handle your claim with the insurance company on your behalf.
Are Real Estate Brokers (i.e., property managers or broker of record) allowed to handle claims on behalf of thier clients in MN?
NO. In a recent letter from the Minnesota Department of Commerce, the department clearly states: “It is the position of the Commerce Department that licensed real estate brokers are not by default, or by exception in law, allowed to adjust their client’s first-party claims without a license. Minnesota Law clearly articulates the requirements needed to become a licensed public adjuster in our state. Therefore, it has not been the practice of the Commerce Department to provide guidance that would state that “managing” a client’s property pursuant to a Minnesota real estate broker license would create an exception to Minnesota Statue 72B.03, which specifically requires a license to adjust first-party claims.” Martin Fleischhacker, Acting Assistant Commissioner, Minnesota Department of Commerce
Is someone with Power-of-Attorney allowed to settle claims on behalf of someone else in MN?
NO. If you have Power-of-Attorney, you can hire a Public Adjuster to represent the Principle but that doesn’t give you the legal right to settle the insurance claim on their behalf.
